While I think the law supports the argument that the Trump administration exceeded its statutory authority under IEEPA, and SCOTUS’s conservative bloc is very much against Congress delegating its legislative authority, I wouldn’t be surprised if the court made a middle of the road decision or even reversed the decision below. The market’s reaction is even more difficult to gauge.

Yes, you lack the potential for short term explosive growth, but over the years you will always beat an investor who does not diversify. The Federal government is the institution that governs an ETF of all state activities.
